CVM manterá regras após mudança contábil do Fisco às empresas
Decisão da Receita que obriga as companhias a aplicar os critérios contábeis anteriores ao IFRS para alguns cálculos fiscais e/ou tributários não irá alterar as exigências do órgão.
A decisão da Receita Federal que obriga as companhias a aplicar os critérios contábeis anteriores ao IFRS para alguns cálculos fiscais e/ou tributários não irá alterar as exigências da Comissão de Valores Mobiliários, órgão regulador do mercado de capitais. Pela exigência da Receita, as empresas terão de manter cálculos separados para acionistas (IFRS) e para a parte tributária.
O Fisco passa a vedar o uso do IFRS para o cálculo de dividendos e juros sobre capital próprio, por exemplo. Questionada sobre a decisão, a CVM frisou, por meio de sua assessoria de imprensa, que as competências e atuações da Receita e da CVM são independentes.
"A Instrução Normativa objeto de sua solicitação trata de assuntos competentes à Receita Federal", respondeu a autarquia. Pela interpretação da CVM, a escrituração contábil fiscal será exigida a partir de 2014, mas ficará restrita à Receita.
"Ressalta-se que a CVM não recebe informações com critérios tributários. Portanto, dentro da esfera de competência desta Autarquia, no que se refere a padrões e critérios contábeis, as companhias abertas devem seguir a legislação vigente (Lei nº 6.404) e os normativos da CVM em vigor".
